Minimum Advertised Pricing Policy

BituboUSA Minimum Advertised Pricing (MAP) Policy Agreement

Effective March 1, 2023, the following Minimum Advertised Pricing (MAP) policy will be enforced for all BituboUSA products. This policy is designed to maintain the brand's integrity, support reseller competitiveness, and ensure consistent pricing across all platforms. BituboUSA allows its resellers to sell products through various channels, but all must adhere to the guidelines set forth in this policy to ensure a fair marketplace for everyone.

Key Guidelines:

  1. MSRP Schedule:

BituboUSA will periodically publish the Manufacturer's Suggested Retail Price (MSRP) for all products. Resellers are permitted to advertise prices no lower than 10% below the MSRP. Any advertisements featuring prices below this threshold will be considered a violation of this MAP policy.

  1. Where It Applies:

The MAP policy applies to all forms of advertising, including:

  • Flyers
  • Online stores
  • Emails
  • Catalogs

Exemption: In-store promotions or private communications not widely distributed are exempt from this policy.

  1. Bundled Offers:

When advertising bundles or including free/discounted products with BituboUSA items, the total value of the package must reflect the combined MSRP of all included products, ensuring that the effective price of any BituboUSA product does not fall below the 10% reduction threshold.

  1. Prohibited Pricing Displays:

Resellers must not engage in the following prohibited pricing practices:

  • Using visible price alterations like strikeouts or suggesting customers "call for price" or "add to cart for price."
  • Any form of visible or implied discount that reflects a price lower than 10% below MSRP.

 

  1. Selling Price Flexibility:

While the policy governs advertised prices, resellers retain the flexibility to sell BituboUSA products at any price to individual customers through in-store or phone transactions. This policy only applies to public advertisements.

  1. Internet Auctions:

BituboUSA products sold via internet auction sites must adhere to MSRP guidelines. "Best Offer" formats, or any pricing mechanisms that allow consumers to negotiate below the advertised MSRP, are strictly prohibited.

  1. Promotions and Coupons:
  • BituboUSA products may not be included in storewide promotions or discounts that result in prices below the 10% threshold from the MSRP.
  • However, offering coupons for future purchases not tied to current BituboUSA products is allowed.
  1. Third-Party Platforms:

Selling BituboUSA products on unauthorized third-party sites such as Amazon, Walmart, or similar platforms is strictly prohibited unless expressly authorized in writing by BituboUSA.

  1. Policy Violations:

Intentional or repeated violations of this MAP policy will result in the following penalties:

  • Immediate suspension of product shipments.
  • Loss of discounts, incentives, or reseller privileges.
  • Possible termination of the business relationship with BituboUSA.
  1. MAP Policy Adjustments:

BituboUSA reserves the right to modify, suspend, or adjust the MAP policy or MSRP for any product at its sole discretion. Such changes will apply equally to all resellers. In the event of special promotions or MSRP adjustments, all resellers will be notified in advance to comply with the updated policy.
